LEGAL TERMS AND CONDITIONS FOR PARTICIPATION
- Purpose of Prize Draw
This Prize Draw is promoted and organised by SESDERMA S.L., hereinafter referred to as SESDERMA, with CIF B97443394, established to these effects at C/Massamagrell 3, 46138, Rafelbuñol, Valencia, Spain, and with the following contact email address: info@sesderma.com, and is subject to the legal terms and conditions contained in this document (henceforth called “Terms and Conditions” or “T&C”.)
The aim of the mentioned Prize Draw is to draw 2 weekend experiences, “Beauty Experience”, in Valencia, among all the users who place an order through the website www.sesderma.com, between 1st and 30th November, 2019.
Scope of the Prize Draw in terms Personal, Geographical and Timescale
2.1 Personal scope
This Draw is addressed to persons of legal age who are legally resident in Spain. Employees of the Organiser, relatives or any other person directly or indirectly involved in the conception, implementation or management of the Prize Draw will not be eligible.
2.2 Geographical scope
The geographical scope of the Draw encompasses the entire national Spanish territory.
2.3 Temporal scope or Promotional Period
The duration of the Draw covers the period from Friday 1st November at 00:00 to Saturday 30th November at 23:59 (the “Promotional Period” hereon). Likewise, SESDERMA reserves the right to extend or modify the Promotional Period.
SESDERMA reserves the right to suspend, postpone, cancel or modify the duration of draws at any time prior to conclusion, provided that there are reasons justifying this.
- Participation requirements
Participation in the Draw is voluntary and subject to the purchase of one or several items on the website www.sesderma.com. Each order placed on www.sesderma.com during the promotional period entitles the person to enter the prize draw.
Incomplete, cancelled or void orders will not be considered.
Entering in person or through purchasing products is not permitted under any circumstance. Participation is only valid though the www.sesderma.com website.
Participation in the Prize Draw is restricted to people over 18.
- Operation of Prize Draw
The promotion is carried out through the website www.sesderma.com. Each participant must place an order of products through the website, obtaining one participation option with each order, to be eligible for 1 out of the 2 prizes available.
Among all the participants that meet the requirements, a certified random draw via the application Sortea2 will pick 2 winners and 2 substitutes randomly.
The Organiser will notify the Winner via the same e-mail address he/she used to place the order which entitled him/her to enter the draw.
Once the winners have been notified, they must send a private message to SESDERMA providing their personal details in order to book the dates in which they will enjoy their prize.
If after a 48 hour deadline no reply has been received from the Winner, it will be understood that he/she renounces the Prize, and the Organiser will send a notification to the first substitute Winner to inform them about the withdrawal of the Winner and invite him/her to benefit from the prize. The same process will operate for each substitute Winner until the Prize has been formally accepted. If the Prize remains unclaimed from the Winner and the substitute Winners in the given deadline, the Prize shall be declared void.
The Prize may not be modified, resold, transferred for an amount or redeemed for cash or another prize of equal or similar value.
Once the acceptance has been received, failure by the Winner —or substitute Winner, as applicable — to attend on the agreed date and place of collection, will result in the Prize being declared void.
SESDERMA will not be liable for any potential incidence during delivery or any other circumstance caused by third parties that may affect the Prize.
The Prize shall not be transferred to a third party under any circumstance, nor will the Winner be entitled to redeem its value by cash.
- Prizes
The Winner of the Prize Draw will be entitled to enjoy two days of “Beauty Experience” in Valencia, for the winner and a person of their choice. This two-day Beauty Experience for two people includes:
- Travel from the Winner’s city of residence to Valencia for two people. The Organiser reserves the right to decide the means of transport (train or airplane) for the journey. Travel dates will be set by mutual agreement between the Organiser and Winners.
- 2 nights for two people in a four-star hotel chosen by the Organiser, as well as the transfers by taxi in Valencia, from station/airport to hotel, and from hotel to the treatments venue.
- Medical appointment of diagnosis in Clínica Dr. Serrano, for two.
- Medical aesthetic treatment prescribed by the dermatologist for each person.
- Treatments in Dr. Serrano Wellness Centre, including: Hammam, massage, hairdresser (washing and drying), manicure and pedicure.
- And Sesderma products for one-year daily routine for two people: includes 12 creams, 12 serums, 12 eye contours and 12 cleansing liposomal waters.
SESDERMA reserves, if necessary, the right to replace some of the products/experiences of the Prize with a product/experience of similar characteristics and price.
The awarded prize will not be transferable or subject to change, alteration or compensation at the request of the Participants and thus, it may not be redeemable for any other product or money.
Any tax burden that may arise from the acceptance of the prize will be covered by the Winner, as well as any other expenditure arising from the promotion which is not specifically borne by SESDERMA in the present Legal Terms and Conditions.
- General dispositions and legal disclaimer.
SESDERMA shall not be responsible for the truthfulness of the details provided by the participants. However, it will make available all possible and necessary means to avoid the provision of incorrect or false data. Hence, if incorrect or erroneous details were provided, SESDERMA shall not be liable for the incidences that could arise from the incorrectness or falseness of the data provided, in particular, regarding the inability to contact the prize Winner to inform him/her and/or any other relevant circumstance regarding the Prize Draw.
The Organiser will be able to use all necessary means to resolve those disputes and conflicts arising during the development of the Prize Draw, provided that these measures are not unduly detrimental to the Participants and are equitable.
Furthermore, the Participants release SESDERMA from any claim based on publicity right, copyrights or trademark infringement, defamation or invasion of privacy and delivery of goods.
The maximum term established for any type of complaint referring and/or relating to Draws expires after two months from its completion date. Once this term is finished, all compensation rights will be forfeited.
In any case, SESDERMA shall not be liable in cases of force majeure or fortuitous event which may prevent participation in the Draw or the enjoyment of the prize whether in the whole or in part.
- Acceptance and deposit of Legal Terms and Conditions
Participation in this Draw and acceptance of the prize entails the full acceptance of the present Term and Conditions. The Organiser has the right to alter the Terms and Conditions if such thing was required by the circumstances, and clarify any unforeseen questions that may arise from these.
In the event that a provision of the Terms and Conditions is declared null or invalid, the remaining provisions will continue in force and unaffected.
Moreover, the Organiser reserves the right to cancel, postpone, reduce or change the Prize Draws if forced by the circumstances, without needing to justify the decision or assume any kind of liability as a consequence, always without prejudice to the rights acquired by the Participants.
- Privacy Policy or Data Protection
Who is accountable for the processing of personal data?
SESDERMA SL is Responsible for Processing the personal data provided by yourself. For this purpose, the registered office is established at C/Massamagrell 3 46138, Rafelbuñol (Valencia, Spain), and with CIF B97443394.
Due to the nature of the services we render, SESDERMA is fully committed to privacy protection and processing of personal data, and undertakes all the necessary efforts to meet the applicable regulations. To this effect, personal data is managed safely and carefully.
What legal foundation legitimises the treatment of your personal data?
In compliance with the applicable legislation on data protection, and specifically in EU-regulation no. 2016/679 of the European Parliament and the Council, of 27th April 2016, concerning the protection of natural persons with regard to the processing and free movement of personal data, all Users entering the Draw give consent to the processing of their personal data, this being the basis of legitimation. Such treatment will be understood to be granted unambiguously, and its acceptance shall be considered a clear affirmative act on your behalf where such consent is expressed.
For what purpose do we collect your personal data?
The main purpose of the processing of your personal data is managing the Draw regulated in these Terms and Conditions, processing part taking and, ultimately, contacting You to notify you that you are a winner.
Likewise, concerning the purpose described above, SESDERMA may publish the name of the winner in its social media to inform the rest of participants in the Draw.
In addition, SESDERMA may post images of the winners during the enjoyment of the awarded experience, to its website and social networking sites, for commercial purposes.
We also collect your data in order to receive and manage information requests, doubts and complaints, as well as to get feedback from users, in regards to the Prize Draw.
Should you want to receive information on our services, your data will be used as a source for market research, in order to measure the quality of our products and services, but also to send information of interest on new promotions or products.
Veracity of data
Participants guarantee that the personal details provided are truthful and are liable for informing SESDERMA about any modification thereof. SESDERMA reserves the right to disqualify from the present promotion any Participant providing false personal details. You are recommended to exercise the utmost diligence in the matter of Data Protection and use all the security tools. SESDERMA shall not be liable for illegal theft, changes or loss of data.
8.5 How long will we keep your personal data for?
Personal details will be kept for the time necessary to meet the purpose for which they were collected, according to the legal basis of data processing, in conformity with legal obligations, as well as to identify responsibilities that may result from accomplishing the purpose or processing the data.

8.6 Who can be assignee or addressee of your personal data?
Personal details shall not be provided to third parties, except if their transferring to public or private entities is necessary or required in order to manage a business relationship or if contemplated in the Law.

Please indicate which of the mentioned rights you wish to access providing a photocopy of your ID or equivalent if sent by mail.
In any case, however, you are entitled to submit a claim before the Spanish Data Protection Agency (https://www.aepd.es/).
- Applicable Law and Jurisdiction
The Legal Terms and Conditions herein are governed by Spanish Law. For resolution of conflicts, the parties are submitted voluntarily, and with renouncement to any other jurisdiction, to the Courts and Tribunals of residence of the Organiser.
